Terms of use for open data
Application editors, developers, and other data consumers may use the data from this portal freely and free of charge. The use of the data is subject to the following terms of use.
The applicable legal regulations regarding the information and open data to be processed are:
- Law 37/2007, of November 16, on the reuse of public sector information, as well as Royal Decree 1495/2011, which approves the regulations for its implementation.
- Royal Decree 4/2010, of January 8, regulating the National Interoperability Framework (ENI) within the scope of Electronic Administration.
- Law 19/2013, of December 9, on transparency, access to public information, and good governance (state framework).
- Law 19/2014, of December 29, on transparency, access to public information, and good governance (regional framework).
- Decree 8/2021, of February 9, on transparency and the right of access to public information, which develops it.
- Law 29/2010, on the use of electronic media in the Catalan public sector.
- Royal Legislative Decree 1/1996, of April 12, approving the consolidated text of the Intellectual Property Law, which regularizes, clarifies, and harmonizes the applicable legal provisions.
Reuse of Information and Restrictions
According to Article 17 of Law 19/2014, data reuse can be done in two ways: on one hand, freely and without restrictions, and on the other hand, subject to obtaining a Creative Commons recognition license, due to the protection of other rights or legal interests or upon prior request from the interested party.
In any case, the open data portal specifies the type of reuse applicable to each type of information, depending on the relevant modality.
Free Data Provision and Creative Commons Licenses
In general, users are granted free and unrestricted authorization to reuse public information and data contained in the CGIM open data portal.
Regarding data usage, in accordance with Article 8 of Law 37/2007, of November 16, users who make use of the portal’s data and information assume the following obligations upon downloading and using the data:
- The content of the information cannot be altered.
- The meaning of the information cannot be distorted.
- The source must be cited, and the requirements established in the data usage license must be met.
- The date of the last update must be mentioned.
Without prejudice to the free use of data and information, when applicable and as indicated within the portal, users must comply with the Creative Commons license specified.
Legal Notice, Terms of Use, and Cookies
The CGIM portal uses cookies, which are duly reported in the “Cookie Policy” section of the T-mobilitat website and previously accepted by the user.
Additionally, the CGIM open data portal is subject to the legal notice and general conditions of the website and app, as duly outlined on the T-mobilitat website.
Disclaimer of Liability
The user acknowledges that ATM has created and developed the portal in good faith, using information from internal and external sources, and offers it in its current state to users, even though it may contain inaccuracies or errors. Therefore, the user releases ATM from any liability regarding the reliability, usefulness, or false expectations that the portal may cause.
In the event that the user causes any type of damage or harm to third parties, they will be solely responsible. Likewise, the user will bear all expenses, costs, and, where applicable, compensation arising from legal proceedings resulting from the damages caused.
